Labour reform is coming to SA, but the road is still long, according to a leading employment lawyer
Proposed amendments to SA’s labour legislation, currently the topic of hot debate with ministers Trevor Manuel and Pravin Gordhan calling for more jobs friendly legislation, were thrown back at the labour department in 2010 for being badly drafted.
The proposed amendments sought the total removal of labour brokers, which appeared to cow-tow to union and political demands, which would have left this sector totally unregulated. New powers for the labour court on constitutional matters were seen as being particularly worrying as the constitutional court is empowered for that very purpose.
Please note that the proposed amendments have gone back to Nedlac for further debate; these new draft bills are:
1. Labour Relations Act, Employment Equity Act
2. The Basic Conditions of Service Act
3. Employment Services Bill)
